This is a draft written to cover the essentials for a developer-app registration (TikTok, YouTube). It is not legal advice and hasn't been reviewed by a lawyer -- have it reviewed before relying on it for anything beyond that.

These Terms of Service ("Terms") govern your use of TikTok Viral Clipper (the "App"), a desktop application provided by its developer ("we", "us"). By downloading, installing, or using the App, you agree to these Terms.

1. What the App is

The App runs locally on your own computer. It downloads or reads video you provide, generates a transcript, uses a third-party AI service to suggest clip-worthy moments, exports clips you choose, and can optionally post those clips to TikTok and/or YouTube using your own accounts.

2. Your responsibilities

You are solely responsible for the video content you process, clip, and post with the App, and for having the rights (ownership, license, or permission) to use it.
You are responsible for complying with TikTok's and YouTube's own Terms of Service and community guidelines when posting through the App.
You are responsible for keeping your Anthropic API key, TikTok credentials, and YouTube credentials confidential -- the App stores them locally on your device and it's your responsibility to keep that device secure.
You will not use the App to infringe copyright, harass, or violate any applicable law.

3. Third-party services

The App relies on third-party services -- Anthropic's Claude API, TikTok's Content Posting API, and the YouTube Data API -- to provide some of its features. Your use of those services through the App is also governed by their own terms:

We are not responsible for the availability, accuracy, or behavior of these third-party services, or for changes they make that affect the App.

4. TikTok posting -- private drafts until audited

Until our TikTok developer app has passed TikTok's audit, any clip posted through the App is published as a private ("only me") draft in your TikTok inbox rather than going out publicly. This is a restriction TikTok applies to unaudited developer apps and is outside our control.

5. No warranty

The App is provided "as is" and "as available", without warranties of any kind, express or implied, including but not limited to fitness for a particular purpose, accuracy of the AI-suggested clip moments, or uninterrupted operation.

6. Limitation of liability

To the maximum extent permitted by law, we are not liable for any indirect, incidental, special, or consequential damages arising from your use of the App, including but not limited to lost content, lost revenue, or account action taken by TikTok, YouTube, or Anthropic against your own accounts.

7. Third-party open-source components

The App uses open-source components including FFmpeg, faster-whisper, and yt-dlp, each under their own respective licenses. Their use does not transfer any additional rights to you beyond what those licenses grant.

8. Changes to the App or these Terms

We may update the App or these Terms at any time. Continued use of the App after an update to these Terms constitutes acceptance of the revised Terms. The current version will always be posted at this URL.

9. Termination

You may stop using the App at any time by uninstalling it. We may discontinue the App, or any third-party integration it relies on, at any time.

10. Governing law

These Terms are governed by the laws of England and Wales, without regard to conflict-of-law principles.
